Broadband: IDEC going to court to prevent contracting the ABR Telecom

On Monday, 27/02, the IDEC (Brazilian Institute for Consumer Protection) filed aPublic Civil Action for Justice determines that the exclusion of ABR Telecom(Brazilian Association of Telecommunications Resources) - an association formed by carriers - the selection process of EAq (Entity Aferidora quality) who will be the official measurement of the quality of broadband services and mobile.

The choice of the company should take place as provided in an announcementuntil 29/02/2012. The award will EAq especially to assess the fulfillment of criteria relating to the connection, such as minimum and maximum speed, availability,packet loss, among others. IDEC explains that, despite the prediction of the regulations a provision of measuring software to consumers, the official measurement will be performed by the Contracting Aferidora Quality and passedto Anatel.

The action of the Civil Idec includes Anatel, ABR Telecom itself and against the contractors (Algar, Cape Telecom, Claro, Embratel, GVT, NET, Nextel, Oi,Sercomtel, Telefonica, TIM and Vivo) and components of the Selection Committee (GVT, TIM, Telefonica / Vivo, Algar Telecom, Nextel, Embratel, Claroand Net Services and Oi), with the understanding that assessment needs to beperformed by an impartial entity, independent and neutral decision-making

"Keep ABR Telecom in the process, undermines the principles of impartiality andadministrative morality, in the Federal Constitution and that should permeate the activities of Anatel as being indirect public administration," concluded the manager's legal Idec, Maria Elisa Novais. The action, on 27/02/2012 distributed,has asked for early relief for the immediate exclusion of ABR Telecom company,has not examined by the Court.
